LEGAL GUARANTEE OF CONFORMITY
All Products manufactured by Maurizio Vicini SS and sold on www.beltforyou.com (the “Website”) benefit from the legal guarantee of conformity provided by articles 128-135 of the Consumer Code (“Legal Guarantee”).
WHO IT IS APPLIED TO
The Website is reserved for the sale of the products to the private consumer.

The warranty of Product compliance is restricted to customers of the Website. It applies only to Users who have made a purchase on the Website for purposes unrelated to any entrepreneurial, commercial or professional activity they may carry out.
WHEN IT IS APPLIED
The seller (Maurizio Vicini SS) is liable to the consumer for any lack of conformity that exists at the time the Product is delivered and for defects that appear within two years of that delivery. The Customer may submit a warranty claim to the seller within 2 months from the date of noticing the lack of conformity.
Unless proved otherwise, any lack of conformity which becomes apparent within six months of delivery of the goods shall be presumed to have existed at the time of delivery unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity.
From the seventh month following the delivery of the Product, the consumer needs to demonstrate that the lack of conformity already existed when the good was delivered.
The user shall supply proof of purchase date and delivery date of the Product, to the request to use the Legal Guarantee for compliance.
For this purpose, therefore, Customers should keep the order receipt/purchase invoice, delivery note or any other document that is able to confirm the date of purchase (e.g. credit card statement or bank statement) and the delivery date.
WHAT IS A LACK OF CONFORMITY?
A lack of conformity arises when a product:
- Is not fit for the purposes for which goods of the same type are normally used;
- Does not comply with the description given by the seller and does not possess the qualities of the goods which the seller has held out to the consumer as a sample or model;
- Does not show the quality and performance which are normal in goods of the same type and which the consumer can reasonably expect, taking into account any statements made in advertising or on the labelling;
- Is not fit for the use intended by the consumer and which has been known to the seller at the time of conclusion of the contract and which the seller has accepted.
The scope of application of the Legal Guarantee does not include any failure or malfunction caused by accidental events or events which the Customer is responsible for or because the product was not used in accordance with its intended use and/or the Technical Documentation attached to the product.

REMEDIES AVAILABLE TO CUSTOMERS
In the event of lack of conformity duly reported within the applicable time limits, Customers have the right:
– Firstly, to request that the good be brought into conformity, free of charge, by repairing or replacing it – at their discretion – unless the remedy required is objectively impossible or excessively expensive compared to the other option;
– Secondly (that is, in the event that repairing or replacing the good is objectively impossible or overly expensive or that the good has not been repaired or replaced within a reasonable period of time, or the repair or replacement carried out previously has caused significant inconvenience to the consumer), to request a reduction in price or termination of the contract, at their discretion.
The remedy requested is excessively expensive if it imposes costs on the seller which are unreasonable compared to alternative remedies, taking into account: (i) The value that the good would have if there were no lack of conformity; (ii) The significance of the lack of conformity; (iii) Whether the alternative remedy could be completed without significant inconvenience to the consumer.
WHAT TO DO IN THE EVENT OF A LACK OF CONFORMITY
In the event that a product purchased on the Website during the period of validity of the Legal Guarantee shows a possible lack of conformity, the Customer must inform the Customer Service according to the following procedures:

Please send a copy of the Order Confirmation and/or the delivery note or any other document that is able to confirm the date of purchase and the delivery date.
In the event that the defect is confirmed, within the prescribed period, the user may choose between repair or replacement of the good. The Seller will assess the discrepancy and, if valid, will repair or replace the defective product as soon as possible, no later than sixty (60) days from the date the return was received, with the exception of force majeure, fortuitous events or grave situations.
Within this period, the new or repaired Product will be delivered to the user. In the event that the remedy (repair or replacement) initially chosen by the user is not completed within the specified period, the user may request one of the alternative remedies provided for by the Legal Guarantee (replacement, if the user requested the repair; repair, if the user requested the replacement; price reduction or termination of the contract).
If the Product is found to be compliant, the Seller will not apply the Legal Guarantee and all charges for repair, replacement and shipping shall be paid by the user.
The Seller will promptly notify the user of the negative outcome of the returns procedure and of the aforementioned charges. Thus, the User can decide whether to have the repair or replacement carried out at his/her own expense.
The User shall authorize the repair or replacement at his/her expense and accept costs and methods of payment in writing.
